Case Status

Plaintiffs filed their Consolidated Class Action Complaint with the Court on July 11, 2025. On August 25, 2025, Defendants filed a motion to dismiss as well as a motion to stay the case pending resolution of the Department of Justice’s civil action United States v. ByteDance Ltd., No. 2:24-cv-06535. After a hearing on these issues on November 6, 2025, the Court denied Defendants’ motion to stay and denied their motion to dismiss except as to state law claims in which no Plaintiff then resided. Co-Lead Counsel filed an Amended Consolidated Class Action Complaint on December 8, 2025, adding numerous Plaintiffs from additional states.

Case Overview

On February 27th, 2025, Keller Rohrback L.L.P. filed a class action complaint in the U.S. District Court for the Northern District of California on behalf of a nationwide class, alleging that Defendants have knowingly collected and used the personal information of users under the age of 13 through the popular TikTok social media platform and its predecessor, Musical.ly. Plaintiffs allege that Defendants unlawfully collect and use the personal information of children under 13 without parental knowledge or consent, as defined under the Children’s Online Privacy Protection Act (COPPA).

On April 3, 2025, the Judicial Panel on Multidistrict Litigation (JPML) ordered Keller Rohrback’s action and similar actions around the country to be consolidated and transferred to the Central District of California before the Honorable George H. Wu.

On June 3, 2025, Keller Rohrback partner Derek Loeser was appointed Interim Co-Lead Counsel in this litigation.
