Case Status

On January 29, 2025, Keller Rohrback filed the lawsuit Smith v. Microsoft Corp. Around the same time, multiple other plaintiffs filed class action lawsuits against Microsoft for the same conduct. On March 3, 2025, the Honorable Ricardo S. Martinez consolidated Smith and certain other lawsuits into a single proceeding and appointed Derek Loeser as interim class counsel to coordinate the litigation, along with Jason T. Dennett of Tousley Brain Stephens PLLC, Gary M. Klinger of Milberg Coleman Bryson Phillips Grossman, PLLC, and Adam Polk of Girard Sharp LLP. 

On May 2, 2025, Plaintiffs filed a consolidated class action complaint, which was amended on June 13, 2025. 

On June 27, 2025, Microsoft moved to dismiss the amended consolidated complaint. That motion has been fully briefed and remains pending before the Court.

Case Overview

Plaintiffs are online content creators who allege that Microsoft Corporation wrongfully diverted affiliate commissions through its Microsoft Edge Shopping browser extension. These creators earn income by posting affiliate links that allow retailers to credit them when a viewer purchases a recommended product. Plaintiffs allege that Microsoft designed its browser extension to substitute Microsoft’s own affiliate tracking codes during the checkout process, making it appear as if Microsoft were the source of the “last click” and allowing it to claim commissions that would have otherwise gone to creators.

Plaintiffs contend this conduct improperly exploits industry attribution rules and deprives creators of revenue they earned through their marketing efforts. Plaintiffs assert that Microsoft’s practices constitute intentional interference with contractual and prospective economic relationships, unjust enrichment, and violations of consumer protection and computer fraud laws. Plaintiffs seek damages, restitution, and injunctive relief on behalf of a nationwide class of similarly situated content creators.
