Aspen Acres Fire Litigation
Case Overview
The Aspen Acres Fire ignited on the morning of June 29, 2026, near the Aspen Acres Campground in Custer County, Colorado. The wind-driven blaze quickly became one of the largest fires in Colorado history. Fueled by sustained winds of 40 mph and gusts up to 100 mph during a National Weather Service Red Flag Warning, the fire scorched over 100,000 acres. The fire damaged or destroyed over 900 structures, including over 300 homes, and led to the evacuation of thousands of residents across southern Colorado. Subsequent debris flow and flooding in the burn scar left after the fire also damaged additional properties.
Keller Rohrback filed suit against San Isabel Electric Association, Inc., alleging that the fire was caused by their negligent maintenance and operation of electrical infrastructure.
The lawsuit brings forward multiple claims, including negligence, trespass, private and public nuisance, inverse condemnation, willful and wanton conduct, and negligent infliction of emotional distress. Plaintiffs seek compensatory damages for property destruction and loss of use, emotional distress, and other losses, as well as exemplary damages to hold the defendants accountable for their conduct. A jury trial has been demanded.
