Case Status

Keller Rohrback L.L.P. filed the Class Action complaint Mahoney v. Allstate Corp. with the court on February 11, 2025. On April 10, 2025, the Court consolidated the Mahoney lawsuit with several other lawsuits filed against Allstate and Arity which allege substantially similar conduct and harms. Plaintiffs filed their consolidated complaint on May 27, 2025, and Defendants moved to dismiss the litigation on July 10, 2025. 

After the parties completed briefing on Defendants’ motion to dismiss, United States District Judge Jeremy C. Daniel denied most of Defendants’ motion to dismiss on March 3, 2026, and dismissed only Counts II, IX and XXXI of the Complaint. Defendants filed their Answer to the remaining claims on April 24, 2026. 

The Court has not yet set a date for the trial of this matter. Plaintiffs had demanded a jury trial.

Case Overview

On February 11th, 2025, Keller Rohrback L.L.P. filed a class action complaint in the U.S. District Court for the Northern District of Illinois against Defendants The Allstate Corporation, Allstate Insurance Company, Allstate Vehicle and Property Insurance Company, Arity LLC, Arity 875 LLC, and Arity Services, LLC. The complaint, brought on behalf of a nationwide class and state subclasses, alleges that Defendants wrongfully collected Plaintiffs’ personal data from their mobile devices through third-party applications such as Routely, Life360, GasBuddy, and Fuel Rewards without Plaintiffs knowledge or consent, and then sold that highly sensitive data to third parties. 

Defendants gained access to this data by integrating their software into mobile apps developed by third parties, which allowed Defendants to surreptitiously collect consumers’ geolocation and driving data without their consent. Defendants then sold that data to insurance companies. Many consumers have faced steep, unexplained increases in their insurance prices. By collecting their personal data without their knowledge or consent, Plaintiffs allege that Defendants violate the Federal Wiretap Act and Stored Communications Act, as well as other consumer protection laws.
