Keller Rohrback Files Suit Against Hyundai and Kia, Citing Dangerous Vehicle Problems

 

Keller Rohrback L.L.P., a Seattle-based class action law firm, filed suit on Monday, March 4, 2019 against Hyundai Motor Company, Kia Motors Corporation, and their American subsidiaries. The litigation, filed in the United States District Court for the Western District of Washington, arises out of Hyundai’s and Kia’s failure to disclose or timely remedy several serious defects of design and manufacturing that can cause the engines of certain vehicles to suddenly stall while at speed or to burst into flames.

“Consumers pay hard-earned money for their vehicles and expect to be safe when driving them—certainly not to risk sudden engine failures or fires. Even if the vehicles can someday be repaired, Plaintiffs allege they are worth less given the seriousness of these defects,” said Keller Rohrback attorney Gretchen Freeman Cappio, a longtime advocate for car consumers.

Keller Rohrback’s investigation and subsequent suit relating to this fire risk came about after Hyundai and Kia, as a result of an investigation by the National Highway Transportation Safety Administration, issued recalls for over 500,000 Hyundai Tucson and Kia Soul models sold between 2011 and 2016 (depending on the model).

Keller Rohrback’s complaint, which can be reviewed here, calls for Hyundai and Kia to recall and properly repair these fire-prone vehicles, as well as to provide financial relief to all Class Members who have suffered economic damages. If the vehicles can’t be fully repaired, the complaint alleges, Hyundai and Kia should buy them back from consumers.

“Hyundai has previously repaired cars with similar defects, only to have the problems recur because the replacement parts suffered from the same or additional defects.
