In re: Facebook, Inc. Consumer Privacy User Profile Litigation Case Update

Recently, the Court presiding over this case issued an order largely allowing Plaintiffs’ claims to proceed. The Complaint alleges that Facebook broke the law when it enabled third parties—such as the political consulting firm Cambridge Analytica—to access Facebook users’ personal content and information without their authorization. Facebook, the amended complaint alleges, failed to properly protect Facebook users’ content and information from misuse or unauthorized access, and that further violated Facebook users’ privacy and put them at risk of identity theft and further misuse of their personal information.

The order allows the majority of Plaintiffs’ claims to proceed with respect to allegations related to, among other things, Facebook’s: 1) data sharing with apps for users who signed up with Facebook between 2007 and 2009; 2) data sharing with whitelisted apps; 3) data sharing with business partners; and 4) failure to monitor and control how apps used the user data they received via the Facebook platform.
