Settlement Status

The Court has granted final approval to settlements with all the defendants in this class action antitrust litigation. Those defendants are C&S Chemicals, Inc., USALCO, LLC, Southern Ionics, Inc., American Securities LLC, Kemira Chemicals, Inc., Chemtrade Chemical Corp./General Chemical Corp. (and all related entities) and GEO Specialty Chemicals, Inc.

Case Overview

In early 2016, Keller Rohrback filed numerous class action complaints in the federal courts on behalf of several municipalities in the states of Washington, California and Arizona. The complaints contained claims against the major manufacturers of liquid aluminum sulfate (“Alum”) who were alleged to have engaged in a conspiracy to artificially inflate the price of this essential chemical used in municipal water treatment. The complaints alleged a conspiracy going as far back as 1997 and through at least February 2011. As a result of these antitrust violations, municipalities – and their taxpayers – had overpaid millions of dollars to the co-conspirators for the Alum they purchased during the long life of this conspiracy.

The class action cases filed by Keller Rohrback, and many other cases with similar allegations, were consolidated in the United States District Court, District of New Jersey for pretrial activity. The litigation entitled In re: Liquid Aluminum Sulfate Antitrust Litigation, and is proceeding before the Honorable Madeline Cox Arleo. On March 12, 2020, the Court issued an Order authorizing the transfer of settlement funds to pay claims of the Settlement Class Members.
