On September 28, 2018, the Court granted final approval to the settlement in this class action litigation. The settlement provided for a $10.00 payment to each class member who submitted a valid claim and two $5.00 vouchers to be redeemed for on-line purchase. The distribution of the settlement benefits to the Class Members ended in December 2018.
In May 2017, a class action complaint was filed against Papa Murphy’s Holdings, Inc. and Papa Murphy’s International, LLC for violations of the Telephone Consumer Protection Act (“TCPA”). The complaint alleged the invasion of privacy by Papa Murphy’s by the sending of unsolicited commercial text messages to the class members between October 16, 2013 and June 15, 2015. Those unwanted text advertisements also increased the class members cell phone expenses. The parties litigated the case through discovery and class certification briefing, and settled the case in early 2018.
