Cocanour, et al. v. National Shooting Sports Foundation, Inc.United States District Court, District of Connecticut
Case No. 3:25-cv-01571

Case Status

Keller Rohrback, along with co-counsel, filed this class action complaint in the U.S. District Court for the District of Connecticut on September 22, 2025, and filed an amended complaint on October 17, 2025.

On December 16, 2025, NSSF moved to dismiss the amended complaint. That motion has been fully briefed and remains pending before United States District Judge Omar A. Williams. Under the Court’s scheduling order, the parties will hold their discovery conference within 30 days after the Court rules on the motion to dismiss, so discovery has not yet begun.

The Court has not yet set a date for the trial of this matter. Plaintiffs have demanded a jury trial.

Case Overview

Plaintiffs allege that the National Shooting Sports Foundation (NSSF), the trade association for the firearms industry, built and maintained a large database of personal information about people who purchased firearms, using warranty cards and other sources. According to the amended complaint, manufacturers and retailers provided the warranty-card data (which included contact details along with demographic and lifestyle information) and NSSF compiled it beginning in the 1990s. NSSF further expanded the database over time. Plaintiffs contend that NSSF then used this information for political messaging across multiple election cycles, including a 2016 effort that involved the political consulting firm Cambridge Analytica.
Plaintiffs allege that the warranty cards never disclosed that this information would be shared with NSSF or used for political purposes, and that some cards promised the information would be kept confidential. By obtaining and using firearms purchasers’ private data without their knowledge or consent, and without paying for its value, Plaintiffs allege that NSSF was unjustly enriched. Plaintiffs seek to represent a nationwide class of individuals whose personally identifiable information NSSF received because of their purchase of a firearm or ammunition from a manufacturer or retailer, from 1990 to the present.
On behalf of the class, Plaintiffs assert a claim for unjust enrichment and seek disgorgement and restitution of the profits NSSF allegedly obtained, a declaration that NSSF was unjustly enriched, punitive damages, and attorneys’ fees, costs, and interest.
