Case Overview
Keller Rohrback is serving on the Executive Committee in this antitrust action filed on behalf of purchasers of dental equipment and supplies directly from Patterson Companies, Inc., Henry Schein, Inc., and/or Benco Dental Supply Company.
This litigation was filed under Section 1 of the Sherman Act, 15 U.S.C. § 1, concerning allegations of a conspiracy to prevent competition from more efficient providers of dental supplies. Plaintiffs specifically alleged that Defendants Patterson Companies, Inc., Henry Schein, Inc., and Benco Dental Supply Company acted in concert to fix margins and unlawfully raise barriers to entry by more efficient, lower priced competitors allowing Defendants to maintain artificially high prices and margins. As a result of this activity, it was alleged the dentists paid higher prices for dental supplies than would have been charged absent the conspiracy.
